1. Introduction
Welcome to Suga ("we," "us," or "our"). These Terms of Service ("Terms") govern your participation in our loyalty program, use of our appointment services, and receipt of digital communications. Our digital services are powered by our technology partner, Suga.
2. Loyalty Program
- Earning Points: You may earn loyalty points for purchasing services or products, based on the accumulation rates determined by us.
- No Cash Value: Points are promotional in nature, have no cash value, and cannot be exchanged for cash.
- Redemption: Points may be redeemed for discounts or products as specified in our current rewards chart. We reserve the right to change redemption values at any time.
- Expiration: We reserve the right to expire points if your account remains inactive for [Number] months.
3. Digital Gift Cards
- Gift cards purchased or received are valid only at Suga.
- Gift cards are delivered via email or SMS. We are not responsible if you provide an incorrect email address or phone number.
- Unless prohibited by law, gift cards are non-refundable and cannot be redeemed for cash.
4. Appointments and Cancellations
- By booking an appointment through our system, you agree to arrive on time.
- Cancellation: We require notice of cancellation at least [24/48] hours in advance. Failure to provide notice may result in a cancellation fee.
- We reserve the right to refuse service to anyone for inappropriate behavior or repeated "no-shows."
5. Communications (SMS & Email)
- Consent: By providing your phone number, email and opting in, you authorize Suga (and our service provider, Suga) to send you text messages using an automated system. These may include appointment confirmations, loyalty balance updates, and marketing offers.
- Opt-Out: You may unsubscribe from emails by clicking the "Unsubscribe" link. You may stop text messages at any time by replying STOP.
- Costs: We do not charge for this service, but your mobile carrier's standard message and data rates may apply.
6. Limitation of Liability
Suga is not liable for any indirect or consequential damages arising from your use of our services, including but not limited to system errors regarding loyalty point balances or appointment scheduling glitches.
7. Changes to Terms
We may update these Terms from time to time. Continued use of our services or loyalty program constitutes acceptance of the new Terms.
8. STATE-SPECIFIC ADDENDUM
If you reside in the following jurisdictions, these additional terms apply to you:
A. California Residents (Gift Cards)
- Cash Redemption: If your Gift Card balance is less than $10.00, you may redeem it for cash upon request in-store.
- No Expiration: Gift cards sold in California do not expire and have no inactivity fees.
B. Florida & Oklahoma Residents (SMS Marketing)
- Quiet Hours: We will not send you automated marketing text messages between the hours of 8:00 PM and 8:00 AM in your local time zone.
- Strict Opt-In: By checking the consent box, you are signing a binding agreement to receive marketing. You assert that you are the subscriber or customary user of the phone number provided.
C. New York Residents
Gift Cards: Gift cards purchased in New York remain valid for at least 9 years from the date of purchase. No inactivity fees will be charged until the 25th month of inactivity.
D. Illinois Residents (Biometrics)
If this Business uses facial recognition or fingerprint scanning for "check-in" or loyalty, you consent to the collection of your biometric data. This data will be permanently destroyed when your account is terminated or within 3 years of your last interaction.
